The procurement procedure

Within the pilot project several possible procurement procedures have been proved concerning their usability for energy performance contracting. Following procedures has been surveyed in detail:

Design contest with public notice of contest & negotiated procedure

At this procedure after the finish of the design contest the implementation of the measures must be put out to tender. Therewith planning, implementation and maintenance can be in different sources, what can be a big disadvantage for a contracting project.

Negotiated procedure with prior notification

Within the negotiated procedure the proposed measures can be discussed and optimised together with the building owner. The winner of the negotiated procedure is implementing his own concept for measures. Therewith planning, implementation and maintenance is in one source. This procedure has been chosen for the Viennese pilot project.

Open procedure

At this procedure an unlimited number of companies can submit an offer. There is no pre-selection of candidates and no negotiated procedure.

Notification of the procurement of the pilot project

The notification of the procurement has been published at the 25. 9. 2003 in the official journal „Wiener Amtsblatt“ as well as at the internet website of the City of Vienna.

Additional all known Contractors in Austria has been informed by e-mail about the public procurement.
At the internet website of the City of Vienna a form sheet for candidates to apply for participation in the call for tenders as well as further information regarding the building can be downloaded.

Criteria for qualitative selection and selection criteria of Candidates

In a first phase candidates has been proved by criteria for qualitative selection criteria for qualitative selection. The number of candidates invited to submit a tender has been limited by 10. In event of more than 10 candidates fulfil the criteria for qualitative selection, the best of them are selected using the selection criteria selection criteria.

The bidding documents has been sent to the selected candidates at the beginning of November 2003.

Visitation of the building

At the beginning of November 2004 all candidates invited to submit a tender got the possibility for separately visitation of the building to survey the condition of the building, the energy systems, the saving potentials and the user behaviour. These information, which has been acquired during the visitation has been summarised and sent to all candidates.

Negotiation with the tenderer

After the submission of the tenders negotiations has been conducted with all tenderer separately. At this negotiations technical details of the offer have been discussed and the building owner could do suggestion for optimising the technical concept. All these negotiations have been recorded in writing.

After the negotiations all tenderer got a list of measures, which are preferable by the building owner. Based on this list all tenderer had the opportunity to add their offer.

a) The capital value is calculated by the sum of all costs and savings of the building owner within a period of 20 years. All figures are discounted toward the year of the investment. The capital value considers the energy cost savings, the costs of necessary reinvestments and service and maintenance after the contract duration as well as the residual value of the facilities and structural measures at the end of the 20 years period.
